Photo of the year 2011 - Entries

Fotoflock.com is a community photography website that brings together photographers, the industry and professionals. It organizes different type of photographic competitions.

• The contest will include winners and runners-up from POTM contests form September 2010 to August 2011.
• There is no entry fee for any of the contests mentioned above.

• The overall winner of the Photo of the Year will be the image that is selected as the best through a weighted format. This would include choices by the judging panel comprising renowned photographers and the votes from Fotoflock members.
• Judging will be conducted in the month of November. The final results will be declared in the month of December of 2011.

1. They are the sole author of each entry and  it is their original  work;
2. They own the copyright and any other proprietary rights of the images uploaded by them;
3. They have the permission of those pictured in the image for the usage rights required by Fotoflock.com and will indemnify Fotoflock.com, Epson India Pvt. Ltd., Media Sphere Communications Pvt. Ltd., their affiliates, partners and other associates against any claims made by any third parties in respect of any such infringement;
4. They have not licensed or disposed of any rights in the image that would conflict with uses to be made by Fotoflock.com;
5. By entering the competition, the participants grant Fotoflock.com and its sponsors and supporters a non-exclusive, irrevocable licence to reproduce, enlarge, publish or exhibit, on any media, the images for any purpose connected with the competition. This may include, but is not limited to:
   1. Inclusion in a book;
   2. Display at exhibitions;
   3. On a web browser for judging purposes;
   4. On the Fotoflock.com and/or Epson website and on the websites of sponsors and supporters;
      e) For use in press releases to be distributed to national, regional & specialist press giving information about or promoting the competition; and
      f) On any merchandise commissioned by the organisers.
6. Copyright of each image is retained by its respective  photographer.
7. Finalists agree to take part in post-competition publicity.
8. For the purposes of this clause, ‘Photo of the Year’ and ‘Fotoflock.com’ shall be seen as interchangeable terms. For clarity, submitted images may be used to promote the ‘Photo of the Year’. Fotoflock.com includes Epson India Pvt. Ltd, Media Sphere Communications Pvt. Ltd., other associates, affiliates, advertising and marketing agencies and others involved in the contest.
9. Fotoflock.com reserves the right to remove any entries from the competition that it feels may breach or contravene laws of public decency or may bring the photographer into disrepute. Such entries will be deemed as void.
10. The judges decision will be final & binding and no correspondence  will be entered into about the contest or the Judge’s decision..
11. If for any reason the contest is not capable of running as planned, due to infection by computer virus, bugs, worms, trojan horses, denial of service attacks, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Fotoflock.com that corrupt or affect the administration, security, fairness, integrity, or proper conduct of this contest, Fotoflock.com reserves the right, at its sole discretion, to cancel, terminate, modify, or suspend the contest. In such event, no prizes will be awarded. If Fotoflock.com elects to cancel or terminate the contest under any of the circumstances described above, it will not retain any rights in the submitted photographs.

Data Privacy:

• By entering, entrants agree that personal data, including without limitation name and address, may be processed, shared, and otherwise used for the purposes and within the context of the contest and any other purposes outlined in these Official Rules. The data may also be used by Fotoflock.com in order to verify the participant's identity, postal address, and telephone number or to otherwise verify the participant's eligibility to participate in the contest. Participants have the right to access, review, rectify, or cancel any personal data.
• By participating, entrants and voters also agree (a) to be bound by these rules, terms and conditions; and (b) that the decisions of Fotoflock.com are final and binding with respect to all matters relating to the contest. By accepting a prize, each winner agrees that Fotoflock.com may use each winning photograph and each winner's name, photograph, likeness, and/or voice in any publicity or advertising relating to the Contest without further compensation or approval (except where prohibited by law).
• Fotoflock.com reserves the right to verify the validity and originality of any entry and/or entrant (including an entrant's identity and address) and the validity of any voter, and to disqualify any entrant or voter who submits an entry or vote, respectively, that is not in accordance with these rules, terms and conditions or who tampers with the entry or voting process. Failure by Fotoflock.com to enforce any of its rights at any stage does not constitute a waiver of those rights.

Limitation of Liability

• By entering this contest, all entrants agree to release, discharge, and hold harmless Fotoflock.com and their respective parent companies, subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, and prize suppliers, and each of their respective officers, directors, employees and agents (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the contest or receipt or use or misuse of any prize.
• Fotoflock.com assumes no responsibility for any of the following in connection with the contest: any error, omission, interruption, deletion, defect, or delay in operation or transmission; communications line failure; theft or destruction of or unauthorized access to contest entries or votes; or alteration of entries or votes. Fotoflock.com are further not responsible for any problems with or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any email entry or vote to be received on account of technical problems or traffic congestion on the Internet or at any website, human errors of any kind, fraud by any entrant, Finalist or vote, or any combination thereof, including without limitation any injury or damage to entrants', voters’ or any other persons' computers related to or resulting from participation, uploading or downloading of any materials in this contest
